Terms and Conditions for the Use of the Cyber Security Canada CAN CIOSC 104:2021 Badge

  1. Introduction

These Terms and Conditions govern the use of the Cyber Security Canada Badge (hereafter referred to as “the Badge”) by certified organizations (hereafter referred to as “the User”). The Badge is a symbol of commitment to cybersecurity best practices and adherence to the standards set forth by Cyber Security Canada.

  1. Eligibility

Use of the Badge is strictly limited to organizations that have successfully completed the CAN CIOSC 104:2021 certification process as outlined by Cyber Security Canada. The Badge must be used in accordance with the guidelines provided at the time of certification and these Terms and Conditions.

  1. Usage Rights

The User is granted a non-exclusive, non-transferable, revocable license to display the Badge on their digital and physical marketing materials, including but not limited to websites, business cards, and promotional materials, to signify their certification status.

  1. Restrictions

The User agrees not to:

  • Alter, modify, or change the Badge in any way.
  • Use the Badge in a manner that implies sponsorship, endorsement, or affiliation with Cyber Security Canada beyond the certification.
  • Display the Badge in a manner that is misleading, defamatory, illegal, or offensive.
  1. Badge Display Requirements

The Badge must be displayed prominently and in accordance with the display requirements provided below:

Placement and Visibility

  • The Badge shall be displayed prominently on the organization’s digital platforms, such as the website’s footer or header, and on physical marketing materials like business cards and brochures.
  • On digital platforms, the Badge must be placed in a location that is easily visible to visitors, such as beside the organization’s logo or on the certification page.
  • For physical materials, the Badge shall be positioned to ensure clear visibility and recognition.

Size and Proportion

  • The Badge must be used in its original proportions and should not be stretched or compressed.
  • It shall be large enough to be easily recognizable.

Color and Design

  • The Badge must be used in its original color scheme and design.
  • No alterations to the color or design of the Badge are permitted.

Linking

  • When used on digital platforms, the Badge must link back to the Cyber Security Canada website https://cybersecuritycanada.com to verify certification and for visitors to obtain more information about the standard.

Usage with Other Logos

  • If displayed alongside other certifications or logos, the Badge shall be of equal size and prominence.
  • The Badge shall not be combined with any other graphic elements or logos to create a new symbol.

Misuse and Compliance

  • The Badge must not be used in any way that suggests endorsement or partnership with Cyber Security Canada beyond the certification.
  • Organizations must comply with the terms and conditions set by Cyber Security Canada and are subject to review and revocation of the right to display the Badge if misused.

Updates and Changes

  • Organizations are responsible for updating the Badge if a new version is released by Cyber Security Canada.
  • Any changes to the Badge design or display requirements will be communicated to certified organizations, who must comply with the new guidelines.
  1. Compliance and Revocation

Cyber Security Canada reserves the right to revoke the User’s right to use the Badge if the User fails to comply with these Terms and Conditions, or if the User’s certification is suspended or revoked. Upon revocation, the User must cease all use of the Badge immediately.

  1. Indemnification

The User agrees to indemnify and hold harmless Cyber Security Canada and its affiliates, officers, agents, and employees from any claim, demand, loss, liability, or expense arising out of the User’s use of the Badge.

  1. Disclaimer

The Badge is provided ‘as is’ without any warranties, express or implied. Cyber Security Canada disclaims all warranties, including but not limited to, warranties of merchantability and fitness for a particular purpose.

  1. Modification of Terms

Cyber Security Canada reserves the right to modify these Terms and Conditions at any time. Continued use of the Badge after such modifications signifies the User’s agreement to the modified Terms and Conditions.

  1. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Canada, without giving effect to any principles of conflicts of law.
